Điện Biên’s National Assembly deputies offer feedback on draft amendments to the Law on Publishing and the Law on Grassroots Conciliation

ĐBP - On August 5, during the First Extraordinary Session of the 16th National Assembly, group discussions were held regarding the draft Law amending and supplementing a number of articles of the Law on Publishing and the draft Law on Grassroots Conciliation (amended).

Trần Tiến Dũng, Member of the Party Central Committee, Secretary of the Điện Biên provincial Party Committee, and Head of the provincial National Assembly Deputy Delegation, chaired the discussion session in Group 12, which comprises Điện Biên, Vĩnh Long, and Lạng Sơn provinces.

Requesting clarification on regulations regarding publishing-like content in cyberspace

Regarding the draft Law amending and supplementing a number of articles of the Law on Publishing, Trần Tiến Dũng requested deputies to focus feedback on three major issue groups, encompassing State policies toward publishing activities, organizational and operational models of publishing houses, and publishing-like content in cyberspace.

According to the Head of the provincial National Assembly Deputy Delegation, although the draft specified numerous State policies toward publishing activities - such as developing reading culture and credit incentives for publishing networks in particularly difficult areas - these policies remain orientational, lacking concrete details or leaving implementation to detailed government regulations, thus requiring continued perfection to guarantee feasibility upon deployment.

Regarding organizational and operational models of publishing houses, the Head of the provincial National Assembly Deputy Delegation suggested clarifying regulations on the “media publishing corporation” model, noting that as the draft identifies this as a corporate group lacking legal personality yet operating under a parent-subsidiary model, more specific research and regulations are needed to guarantee consistency and convenience during application.

Notably, the Head of the provincial National Assembly Deputy Delegation suggested continued research and perfection of regulations concerning publishing-like content in cyberspace to satisfy management demands amid digital transformation.

Agreeing with this orientation, National Assembly Deputy Vừ A Bằng urged the drafting agency to review and define clear identification criteria, target entities, and application scopes for this type of content, guaranteeing consistency with press laws and related legislation to avoid overlaps and elevate feasibility during deployment.

Regarding regulations on suspending publishing house operations, Deputy Vừ A Bằng suggested supplementing regulations on legal consequences and handling mechanisms during suspension periods, clarifying rights and obligations of publishing houses alongside state management agency responsibilities to protect legitimate rights and interests of related parties and elevate regulatory feasibility.

On regulations regarding the issuance, re-issuance, and revocation of editing practice certificates, the deputy suggested perfecting regulations toward clearly defining authorities to issue, re-issue, and revoke certificates, supplementing mechanisms for individuals whose certificates were revoked to be considered for re-issuance or new issuance upon fully satisfying practice conditions, and clarifying training regulations to guarantee transparency, consistency, and feasibility.

Additionally, Deputy Vừ A Bằng suggested researching and supplementing priority policies to develop reading culture and digital libraries synchronously with digital infrastructure investment, particularly across difficult, mountainous, border, and island areas.

Perfecting regulations on grassroots conciliation

Offering feedback on the draft Law on Grassroots Conciliation (amended), Venerable Thích Đức Thiện, provincial National Assembly Deputy, agreed on the necessity of amending the Law while suggesting continued perfection of legal mechanisms to promote the role of dignitaries, officials, monastics, and influential figures within religious organizations in grassroots conciliation activities. The deputy stated that practical reality demonstrates this force has participated actively and effectively in numerous conciliation cases, yet participation relies mainly on personal prestige without full and consistent legal bases.

The deputy suggested researching and supplementing clear regulations regarding roles, conditions, criteria, scopes, and participation forms for religious dignitaries and officials in conciliation activities, while establishing coordination mechanisms among the Viet Nam Fatherland Front, commune-level authorities, and conciliation teams to leverage social resources effectively, contributing to resolving conflicts and disputes right from the grassroots, maintaining all-people national solidarity, and ensuring alignment with legal regulations.

Participating in the discussion, Deputy Lò Thị Luyến, Deputy Head of the provincial National Assembly Deputy Delegation, suggested continuing to perfect regulations on electing conciliators toward guaranteeing consistency, feasibility, and alignment with practical conditions in each area. The deputy suggested clarifying that entities participating in online voting represent household representatives, supplementing regulations on information security and personal data protection, and researching hybrid voting forms combining online, direct, and ballot-casting methods to facilitate villages and residential groups following administrative unit arrangements.

Commenting on conciliator rights and obligations, the Deputy Head of the provincial National Assembly Deputy Delegation suggested designating a single focal point to receive security and order assurance requests when conducting conciliation, while clarifying responsibilities of assigned agencies to avoid overlaps and facilitate conciliators during duty execution. The deputy also suggested reviewing conciliator notification obligations to guarantee consistency with draft Law regulations.

Furthermore, the deputy suggested supplementing responsibilities for People’s Committees at all levels in organizing training on legal knowledge, professional expertise, and skills for conciliators, guaranteeing consistency between conciliator rights and obligations and state management agency responsibilities.
